What is the context for this testimony?

Dr Waxler was engaged as an expert witness by EBW Laser, a company in litigation with Alcon over alleged unfair trading practices relating to lasers the company leased from Alcon. This litigation is in the form of a countersuit filed by EBW against Alcon when EBW were sued by GE Healthcare Financial through whom the lasers were financed. Dr Waxler was deposed on November 19th, 2004 in the course of this lawsuit.
